By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Service.

All purchases grant you a limited, non-exclusive, non-transferable license to access and experience the Digital Content through the Service. Purchases do not transfer ownership of any intellectual property and do not give you rights to download, copy, redistribute, or otherwise exploit the Digital Content outside of the Service.

Payment processing is handled by Stripe, Inc. By making a purchase, you agree to Stripe's terms and acknowledge that GamePod does not store full payment card numbers.

Due to the nature of digital entertainment content, all purchases are generally final and non-refundable once access has been granted. We may, in our sole discretion, provide refunds or credits in limited circumstances such as duplicate charges, failure to deliver purchased content, or as required by applicable law. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial entertainment purposes.

You agree not to:

• Interfere with or disrupt the integrity or performance of the Service;

• Resell, sublicense, or commercially exploit access to the Service or Digital Content;
• Upload or transmit malicious code, viruses, or harmful content;

The Service captures the choices you make within narrative experiences and may store related behavioral data. You grant GamePod a worldwide, royalty-free, sublicensable license to use this information to operate, personalize, and improve the Service, maintain story continuity, and produce aggregated or anonymized insights. Your choices may be stored and used to personalize future experiences.

The Service uses artificial intelligence and machine-assisted generation to produce narrative content. Story outcomes, narrative content, character behavior, and generated experiences may vary between users and between sessions. AI-generated content may contain errors, inconsistencies, factual inaccuracies, or unexpected results and is provided solely for entertainment purposes. AI-generated content does not reflect the views or opinions of GamePod and should not be relied upon as advice of any kind.

The Service, including all software, text, graphics, audio, characters, stories, universes, quests, trademarks, logos, and other materials, is owned by GamePod or its licensors and is protected by intellectual property laws. No purchase of Digital Content transfers any ownership rights to you. All rights not expressly granted in these Terms are reserved by GamePod.

We strive to keep the Service available but do not guarantee uninterrupted access. GamePod may modify, suspend, or discontinue content, universes, quests, episodes, or features at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

From time to time, we may offer features designated as "beta," "experimental," "preview," or similar. Beta features are provided "as is," may be unstable or incomplete, may be modified or removed at any time, and are excluded from any service-level commitments.

The Service and all content are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, GamePod disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will be accurate, appropriate, or meet your expectations.

To the maximum extent permitted by applicable law, in no event shall GamePod, its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service. GamePod's aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of the amounts you paid to GamePod in the twelve (12) months preceding the claim or one hundred U.S. dollars (US $100).

You agree to indemnify, defend, and hold harmless GamePod and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, including for violation of these Terms, suspected fraud or abuse, or as required by law. You and GamePod agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action.

Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
